General Terms and Conditions
Where Every Second is a Spectacle!
- These terms and conditions apply to bookings made through the website Helicopterflights-mallorca.com (Mook-Aviation UG) or a personal, telephone, or written order of a flight, carried out by Mook-Aviation UG.
- The law of the Federal Republic of Germany is agreed upon, excluding the rules of private international law. The place of jurisdiction is 63450 Hanau, Germany.
- These terms and conditions exclusively apply to the contractual relationship between Mook-Aviation UG and the passenger. Any deviations require written consent/approval from Mook-Aviation UG.
**Ordering and Conclusion of Contracts**
- Orders can be received verbally, by telephone, or in writing. An express written confirmation from Mook Aviation UG is not required for the conclusion of a valid contract but can be provided in writing upon request of either party. The contract is concluded between the passenger of Mook-Aviation UG upon acceptance of the booking or order and, in any case, with the execution of the order.
- Offers from Mook-Aviation UG are always non-binding.
- The contract can be transferred to another person if that person meets the personal requirements mentioned in §2.4 and §2.5. This must be communicated to Mook-Aviation UG in writing at least 24 hours before the flight.
- The minimum age for children not accompanied by a legal guardian on board is 12 years, with a minimum height of 150 cm. A written permission from the legal guardians is required. Helicopter flights are not recommended for infants and children under 3 years of age.
- The maximum weight of each passenger/customer must not exceed 120 kilograms, including clothing.
- If the passenger does not arrive at the airfield for takeoff without prior arrangement, booking confirmations and flight tickets lose their validity without entitlement to a refund of the paid flight price. In the event of withdrawal or cancellation, § 4.4 applies.
**Liability / Insurance / Compensation**
- The helicopters of Mook-Aviation UG are insured through liability insurance, covering claims with holder, passenger, luggage, and freight liability.
- Mook-Aviation UG is only liable for claims of any kind to the extent covered by the insurance risks and sums. Mook-Aviation UG is in no case liable for further claims.
- Unless otherwise agreed, Mook-Aviation UG is not liable for items brought by the passenger/customer unless Mook-Aviation UG has caused the damage or destruction of the items intentionally or through gross negligence.
- Claims for compensation for damages of any kind, including damages not directly caused by the service itself, such as delay, performance prevention for any reason, positive contract violation, negligence in contract conclusion, and tort, are excluded, unless the damage is based on intent or gross negligence and to the extent that the exclusion of claims for damages does not prevent or jeopardize the fulfillment of the contract.
- Liability for unusual damages (consequential damages) is excluded. This also applies to gross negligence.
**Payment**
- Unless otherwise agreed, full payment for flight bookings must be made no later than before departure, otherwise, there is no obligation to perform the flight.
- Payment can be made on-site in cash or in advance by credit card or PayPal via the payment system on the website helicopterflights-mallorca.com.
- Prices include all taxes and fees.
**Cancellation**
- In the event of a cancellation of more than or up to 24 hours before the departure, the full amount will be refunded. For cancellations less than 24 hours, the full invoice amount is due.
- In case of non-appearance of the customer, the full amount of the flight will be charged.
- If Mook-Aviation UG cancels a flight, the full amount will be refunded to the customer according to applicable EU regulations.
- If a flight is canceled due to weather or unexpected government restrictions, the customer is entitled to a full refund unless they want to arrange a new date.
- Once a flight has departed and the customer either wants to cancel the flight or return, no refunds will be made.
**Pricing**
- All prices offered to customers are fixed prices (including all taxes, airport, and handling fees, etc.).
- The prices for flight brokers (resellers) are net prices and do not include commissions but include the usual reseller/partner discount as well as all taxes, airport fees, etc.
- Mook-Aviation UG reserves the right to change prices at any time, with the customer being notified by email before each change.
- Price changes apply only in the event of force majeure (changes in value-added tax, excessive increase in fuel prices, special taxes imposed by the government, etc.), except for flights for which the total amount has already been paid in full.
**Weight Restrictions / Luggage**
- Weight restrictions for passengers and luggage apply to all helicopters. The customer is obliged to inform Mook-Aviation UG of the names and actual weights of all passengers and the weight and dimensions of the luggage (if required) before the flight.
- The sent flight confirmations are based on these weights, and the customer is required to inform Mook-Aviation UG of any changes.
- Mook-Aviation UG reserves the right to refuse the performance of a flight if an exceeding of the weight limit is determined or if the luggage is overweight and/or too large and does not fit securely in the helicopter’s cargo compartment.
**Delays**
- All customers are required to be at the meeting point at Son Bonet Airport at least 15 minutes before the estimated departure time (ETD).
- In the event of a passenger’s delay and if the flight schedule of the aircraft is affected, Mook-Aviation UG will offer an alternative ETD based on this flight schedule and make every effort to serve the customer. If the flight cannot be conducted on the same day, an alternative date will be offered. If the customer cannot perform the flight at the changed ETD or on another date, this situation will be treated as a cancellation, and 100% of the total amount will be invoiced.
- If Mook-Aviation UG delays the flight due to technical or other reasons, an alternative date will be agreed with the customer. If the customer rejects the alternative solution, a full refund will be issued.
- If the customer accepts the delay and/or the flight schedule change, no refund will be issued.
- Once a flight has departed and the customer either wants to cancel the flight or return, no refunds will be made.
**The Flight**
- With the conclusion of the contract, the passenger/customer is entitled to a one-time helicopter flight on the booked route or for the booked flight duration.
- Passengers must arrive at the meeting point at Son Bonet Airport at least 15 minutes before the agreed departure time. In case of late arrival, there is no guarantee that the helicopter will be available. Failure to appear cancels the entitlement to the booked flight. In this case, there is no entitlement to
a refund, and §5.9 applies.
- All passengers must present their passport or identity card upon request. The pilot reserves the right to search passengers or their luggage with a metal detector if deemed necessary.
- If the flight has to be canceled or delayed due to technical problems, bad weather conditions, or unexpected government restrictions, the passenger/customer will be informed appropriately. All flights are conducted under visual flight rules. If the weather conditions are poor and do not allow safe visual flight, the pilot may cancel the flight at short notice. In these cases, a new date will be arranged/confirmed in consultation with the passenger/customer, or alternatively, the entire ticket price will be refunded. There is no entitlement to any consequential damages.
- The passenger/customer must strictly follow the pilot’s instructions. The passenger/customer is fully liable for damage to the helicopter caused by negligence or slight negligence on the part of the passenger/customer.
- Passengers under the influence of alcohol or drugs will be refused flight without replacement. Passengers who violate the pilot’s instructions may be excluded from the flight. In all these cases, there is no refund of the flight price.
- Mook-Aviation UG accepts no liability for personal belongings and luggage of the passengers. The transport of fragile items in the helicopter is at the passenger’s/customer’s own risk; the passenger/customer must follow the pilot’s instructions.
**Withdrawal**
- The passenger/customer can revoke the contract as a consumer in the case of distance contracts up to two weeks after receiving the booking confirmation or the ticket without giving reasons in writing. The period begins with the receipt of the booking confirmation or the ticket. To comply with the revocation period, timely dispatch of the revocation is sufficient. The revocation must be addressed to Mook-Aviation UG in text form.
- The right of withdrawal expires prematurely if the contract is fulfilled or if the customer has expressly agreed.
- In the event of an effective revocation, the services already received must be reimbursed.
- If the end of the two-week withdrawal period falls within the periods mentioned in §4.4, these periods apply in any case.
**Severability Clause**
- If one or more formulations of these conditions do not, no longer, or not completely comply with applicable law, the remaining parts of the conditions remain unaffected in their content and validity.
